Terms of Service and End User License Agreement governing the use of the 7esaby dining calculation platform, receipt apportionment utility, and mobile/web applications.
1. Acceptance of Terms
By downloading, installing, accessing, or using 7esaby (حسابي) ("the App"), you agree to be bound by these Terms of Service and End User License Agreement ("Terms"). If you do not agree to these Terms, do not install, access, or use the App.
2. Scope & Description of Service
7esaby is provided strictly as a mathematical calculation, social expense-splitting, and dining ledger utility. The App assists dining groups in cataloging shared bills, calculating proportional service charges and taxes, claiming menu items, and displaying external payment aliases (e.g., InstaPay).
3. License Grant & Acceptable Use
We grant you a revocable, non-exclusive, non-transferable, limited license to use 7esaby for personal, non-commercial purposes on compatible devices owned or controlled by you.
You agree NOT to:
- Use the App for unlawful, fraudulent, or deceptive financial purposes.
- Reverse engineer, decompile, disassemble, or extract source code from the App.
- Flood, spam, or perform automated denial-of-service attacks against our database or OCR endpoints.
- Input offensive, abusive, defamatory, or infringing text into public participant handles or item descriptions.
4. Absolute Financial Disclaimer (Non-Banking Entity)
Scope of Computation & Non-Banking Status:
- Not a Financial Institution: 7esaby is NOT a bank, payment service provider (PSP), money services business (MSB), money transmitter, digital wallet, or escrow agent.
- No Fund Custody or Processing: 7esaby does not receive, hold, transmit, settle, or custody funds, fiat currency, or stored value of any kind.
- Peer-to-Peer Transactions: Any financial transfers, payments, or balance settlements arranged between users occur entirely outside of 7esaby via independent third-party banking platforms, mobile wallets (e.g. InstaPay), or cash. 7esaby bears no responsibility or liability for failed, fraudulent, incorrect, or disputed money transfers between parties.
5. OCR & Mathematical Accuracy Disclaimer
- Automated Recognition: The receipt scanning capability uses artificial intelligence and optical character recognition (OCR). OCR technology is inherently subject to optical errors resulting from print degradation, paper folds, low lighting, handwriting, thermal ink fading, and formatting anomalies.
- Mandatory User Verification: YOU ARE SOLELY RESPONSIBLE FOR VERIFYING THE ACCURACY OF ALL EXTRACTED ITEMS, QUANTITIES, PRICES, TAXES, SERVICE CHARGES, AND TOTALS BEFORE SETTLING EXPENSES.
- Limitation on Computational Discrepancies: 7esaby makes no guarantees regarding the 100% mathematical precision of OCR scans or sub-penny rounding allocations. 7esaby disclaims all liability for dining disputes, overpayments, underpayments, or interpersonal disagreements arising from the use of the App’s calculations.
6. Intellectual Property
All interface components, algorithms, designs, brand marks, and software powering 7esaby are the proprietary intellectual property of 7esaby and its licensors. Unauthorized reproduction, modification, or redistribution without explicit written permission is prohibited.
7. Disclaimer of Warranties
THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TIMELINESS, OR NON-INFRINGEMENT.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 7ESABY, ITS DEVELOPERS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR PERSONAL DISPUTES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APPLICATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the competent courts of Cairo, Egypt.
10. Termination
We reserve the right to revoke room access, terminate host tokens, or restrict access to automated OCR endpoints for any user who violates these Terms or engages in abuse of our infrastructure.
